1. ACCEPTANCE OF TERMS

0th Root Software Research Private Limited ("0^th Root") provides the 0th Root Secure Network ("0SNet") software and associated services on this website as per these Terms of Use ("ToU"). 0^th Root may update the ToU at any time and without prior notice by posting a new version at http://0snet.info. The software on this site and your use of it is subject to the most recent version of the ToU posted.

2. YOUR REGISTRATION OBLIGATIONS

In consideration of your use of 0SNet, you represent that you are of legal age to form a binding contract under the laws of the Republic of India or other applicable jurisdiction. You also agree to:

• provide true, accurate, current and complete information as prompted by 0SNet (the "Registration Data") and
• maintain and promptly update the Registration Data to keep it true, accurate, current and complete.

If you provide any information that is untrue, inaccurate, not current or incomplete, or 0^th Root has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, 0^th Root has the right to suspend or terminate your account and refuse any and all current or future use of 0SNet (or any portion thereof).

Registration Data and certain other information about you is subject to our Privacy Policy.

4. INDEMNITY

You agree to indemnify and hold 0^th Root and its subsidiaries, affiliates, directors, officers, agents, employees, partners and licensors harmless from any claim or demand, including but not limited to reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or otherwise make available through 0SNet, your use of 0SNet, your connection to 0SNet, your violation of the ToU, or your violation of any rights of another.

5. MODIFICATIONS

You acknowledge that 0^th Root may establish general practices and limits concerning use of 0SNet, including without limitation the maximum number of days that uploaded Content will be retained. You further acknowledge that 0^th Root reserves the right to modify these general practices and limits from time to time. 0^th Root reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, 0SNet (or any part thereof) with or without notice. You agree that 0^th Root shall not be liable to you or to any third party for any modification, suspension or discontinuance of 0SNet.

6. TERMINATION

You agree that 0^th Root may terminate your access to 0SNet for violations of the ToU and/or requests by authorized law enforcement or other government agencies.

7. LINKS

0SNet may provide, or third parties may provide, links to other World Wide Web sites or resources. Because 0^th Root has no control over such sites and resources, you acknowledge and agree that 0^th Root is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that 0^th Root shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

8. DISCLAIMER OF WARRANTIES

You expressly understand and agree that: Your use of 0SNet is at your sole risk. 0SNet is provided on an "as is" and "as available" basis. 0^th Root and its subsidiaries, affiliates, directors, officers, employees and licensors expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. 0^th Root and its subsidiaries, affiliates, directors, officers, employees and licensors make no warranty that

• 0SNet will meet your requirements;
• 0SNet will be uninterrupted, timely, secure or error-free and
• The results that may be obtained from the use of 0SNet will be accurate or reliable. No advice or information, whether oral or written, obtained by you from 0^th Root or through or from 0SNet shall create any warranty not expressly stated in the ToU.

9. LIMITATION OF LIABILITY

You expressly understand and agree that 0^th Root and its subsidiaries, affiliates, directors, officers, employees, agents, partners and licensors shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if advised of the possibility of such damages), resulting from the use or the inability to use 0SNet.

10. GENERAL INFORMATION

(i) Entire Agreement

The ToU constitutes the entire agreement between you and 0^th Root and governs your use of 0SNet, superseding any prior agreements between you and 0^th Root with respect to 0SNet.

(ii) Choice of Law and Forum

The ToU and the relationship between you and 0^th Root shall be governed by the laws of the State of Tamil Nadu without regard to its conflict of law provisions. You and 0^th Root agree to submit to the personal and exclusive jurisdiction of the courts located within the district of Chennai, Tamil Nadu, India

(iii) Waiver and Severability of Terms

The failure of 0^th Root to exercise or enforce any right or provision of the ToU shall not constitute a waiver of such right or provision. If any provision of the ToU is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the ToU remain in full force and effect.
